User Obligations and Responsibilities

2. Conduct Requirements

- Ensure that pets are properly secured during service visits
- Remove or secure valuable items before our arrival
- Disclose any hazardous materials, conditions, or health risks present at the property
- Provide accurate access instructions and be available for communication
- Pay for services in accordance with agreed terms and timelines
- Notify us promptly of any changes to your requirements or contact details
3. Prohibited Activities
You must not:
- Engage in any form of harassment, discrimination, or abusive behaviour towards our staff
- Request services that involve illegal activities or substances
- Interfere with our equipment or cleaning products
- Make false or misleading statements about our services
- Attempt to solicit our employees for private work without company approval
- Use our services for any purpose that violates local, national, or international laws
- Reproduce, duplicate, or exploit our intellectual property without permission
4. Property Access and Safety
You are responsible for ensuring safe access to your property for our cleaning team. This includes providing functional entry systems, adequate lighting, and a safe working environment. You must disclose any potential hazards including but not limited to: asbestos, lead paint, mould, structural damage, aggressive animals, or any other conditions that could pose a risk to our staff's health and safety.
5. Privacy and Confidentiality
You acknowledge that our staff may need access to various areas of your property to provide cleaning services. You agree to secure or remove any confidential documents, sensitive information, or personal items you do not wish to be seen. While our staff are trained to respect your privacy, we cannot guarantee the confidentiality of items left in plain view.
Service Conditions
1. Service Scope and Limitations
Our services include standard residential and light commercial cleaning using eco-friendly products. We do not provide services for hazardous waste removal, pest control, post-construction cleaning (unless specifically arranged), or cleaning that requires specialised equipment beyond our standard tools.
2. Product Specifications
While we use environmentally friendly, plant-based cleaning products, we cannot guarantee that all products will be suitable for every surface or condition. You should inform us of any known sensitivities or special requirements regarding cleaning products.
3. Scheduling and Timing
Service times are approximate and may vary based on traffic, property condition, and other factors. We'll provide an estimated arrival window and will contact you if significant delays occur. You agree to be flexible within reasonable bounds.
4. Service Modifications
We reserve the right to modify the scope of service during a visit if conditions are significantly different from those described during booking, if safety concerns arise, or if additional time or equipment would be required.
Disclaimers and Limitations of Liability
1. Service Warranty Disclaimer
Our services are provided on an "as is" basis. While we strive for excellence and customer satisfaction, we make no warranties, express or implied, regarding:
- The complete removal of all stains, odours, or marks
- Results on surfaces damaged prior to our service
- The suitability of our methods for all surface types
- Outcomes beyond our control, such as pre-existing damage
- The permanence of cleaning results in all circumstances
2. Limitation of Liability
To the fullest extent permitted by law, Greenleaf & Co shall not be liable for:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or use
- Damage to items not properly secured or disclosed as delicate
- Pre-existing damage revealed by the cleaning process
- Damage caused by defects in your property's surfaces or materials
- Any claims exceeding the amount paid for the specific service in question
3. Consequential Damages Exclusion
We are not liable for any indirect or consequential losses arising from our services, including but not limited to: loss of business, loss of profits, loss of anticipated savings, loss of business opportunity, loss of goodwill, or any other indirect or consequential loss.
4. Force Majeure
We shall not be liable for any failure to perform our obligations where such failure is due to circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, civil commotion, pandemic, epidemic, fire, flood, storm, or governmental actions.
5. Claims Procedure
Any claims for damage or dissatisfaction must be reported within 24 hours of service completion. Claims reported after this period may not be considered. We reserve the right to inspect the property and assess the claim before accepting liability. Photographs and detailed descriptions must be provided with all claims.
Indemnification
You agree to indemnify, defend, and hold harmless Greenleaf & Co, our officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable legal fees) arising from:
- Your violation of these Terms and Conditions
- Your violation of any law or the rights of a third party
- Undisclosed hazards or conditions at your property
- False or misleading information provided by you
- Your failure to secure valuable or sensitive items
- Injury to our staff caused by property conditions you failed to disclose
This indemnification obligation survives the termination of your use of our services.
Legal Information
1. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
2. Dispute Resolution
In the event of any dispute, we encourage you to first contact us directly to attempt an amicable resolution. If a dispute cannot be resolved informally, the following process shall apply:
- Written notice of the dispute must be provided within 30 days of the issue arising
- Both parties agree to engage in good faith negotiations for resolution
- If negotiations fail, mediation through an agreed mediator may be pursued
- Only after exhausting informal resolution may legal proceedings commence
3. Severability
If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, the provision shall be severed from these terms. The remaining provisions shall continue in full force and effect.
4. Entire Agreement
These Terms and Conditions, together with our Privacy Policy and Terms of Service, constitute the entire agreement between you and Greenleaf & Co regarding the use of our services and supersede all prior agreements and understandings, whether written or oral.
5. Modification of Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website with the updated "Last updated" date. Your continued use of our services after any changes constitutes acceptance of the modified terms. Material changes will be communicated via email to active customers.
6. Waiver
No waiver of any term or condition of this agreement shall be deemed a further or continuing waiver of such term or condition or any other term or condition. Our failure to assert any right or provision under these terms shall not constitute a waiver of such right or provision.
7. Assignment
You may not assign or transfer these Terms and Conditions or any rights granted hereunder without our prior written consent. We may assign our rights and obligations under these terms without restriction. Any attempted assignment in violation of this section shall be null and void.
Age Restrictions
Our services are intended for adults aged 18 and over. If you are under 18, you may only use our services with the involvement and consent of a parent or legal guardian. By using our services, you represent that you meet this age requirement or have obtained appropriate consent.
Parents and guardians who allow minors to use our services are fully responsible for the minor's actions, including any charges incurred and compliance with these terms.
Acknowledgment and Acceptance
